EMPIRE SOVEREIGN SYSTEMS

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the CENTURION mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Empire Sovereign Systems ("Company," "we," "our," or "us").

2. DESCRIPTION OF SERVICE

CENTURION is a ritual tracking and performance optimization application that provides:

Guided breathing, meditation, and cold exposure protocols
Progress tracking and performance metrics
Ranking and achievement systems
Optional premium features via subscription

The App is designed for personal wellness and self-improvement purposes only.

3. ELIGIBILITY

To use CENTURION, you must:

Be at least 13 years of age (or the minimum age in your jurisdiction)
Be at least 18 years of age to purchase subscriptions
Have the legal capacity to enter into these Terms
Not be prohibited from using the App under applicable law

4. USER ACCOUNTS

4.1 Account Creation

You may use certain features without an account. Premium features require account creation through Apple ID sign-in.

4.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account
All activities that occur under your account
Notifying us immediately of any unauthorized use

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the App or other users.

5. SUBSCRIPTIONS & PAYMENTS

5.1 Subscription Plans

CENTURION offers the following subscription options:

Weekly: Auto-renewing weekly subscription
Annual: Auto-renewing annual subscription

Prices are displayed in the App and may vary by region.

5.2 Billing

Subscriptions are billed through your Apple ID account
Payment is charged upon confirmation of purchase
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period

5.3 Cancellation

You may cancel your subscription at any time through iOS Settings > Apple ID > Subscriptions > CENTURION. No refunds are provided for partial subscription periods.

5.4 Free Trial

If offered, free trials automatically convert to paid subscriptions unless canceled before the trial ends.

6. USER CONDUCT

You agree NOT to:

Use the App for any illegal purpose
Attempt to reverse engineer, decompile, or disassemble the App
Circumvent any security features or access restrictions
Transmit viruses, malware, or harmful code
Interfere with the App's operation or infrastructure
Impersonate any person or entity
Use automated systems to access the App
Resell, redistribute, or sublicense the App

7. HEALTH & SAFETY DISCLAIMER

7.1 Not Medical Advice

CENTURION is NOT a medical device and does NOT provide medical advice. The App is intended for general wellness purposes only.

7.2 Consult a Physician

Before beginning any breathing, cold exposure, or meditation practice, consult with a qualified healthcare provider, especially if you have:

Cardiovascular conditions
Respiratory conditions
Pregnancy
Epilepsy or seizure disorders
Any chronic health condition

7.3 Cold Exposure Warning

Cold exposure practices carry inherent risks including hypothermia, cold shock response, cardiac stress, and drowning (if practiced in water).

NEVER practice cold exposure alone or in water without supervision.

7.4 Assumption of Risk

By using CENTURION, you acknowledge and accept all risks associated with the practices described in the App. You assume full responsibility for your health and safety.

8. INTELLECTUAL PROPERTY

8.1 Ownership

All content, features, and functionality of CENTURION are owned by Empire Sovereign Systems and protected by copyright, trademark, trade secret, and other intellectual property laws.

8.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8.3 Restrictions

You may not copy, modify, or distribute the App, use the App's content for commercial purposes, or remove any copyright or proprietary notices.

9. PRIVACY

Your use of CENTURION is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. DISCLAIMERS

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.2 No Warranty

We do not warrant that the App will be uninterrupted or error-free, defects will be corrected, the App is free of viruses or harmful components, or results from using the App will be accurate or reliable.

11. LIMITATION OF LIABILITY

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPIRE SOVEREIGN SYSTEMS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA, OR GOODWILL, PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.

11.2 Cap on Liability

Our total liability shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Empire Sovereign Systems, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. DISPUTE RESOLUTION

13.1 Informal Resolution

Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least thirty (30) days.

13.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13.3 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. GOVERNING LAW

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. CHANGES TO TERMS

We may modify these Terms at any time. We will notify you of material changes through in-app notification, email (if provided), and updated "Last Updated" date. Your continued use after changes constitutes acceptance of the modified Terms.

16. GENERAL PROVISIONS

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Empire Sovereign Systems.
Severability: If any provision is found unenforceable, the remaining provisions shall remain in effect.
Waiver: Our failure to enforce any right shall not constitute a waiver.
Assignment: You may not assign these Terms without our prior written consent.

18. APPLE-SPECIFIC TERMS

As required by Apple:

These Terms are between you and Empire Sovereign Systems, not Apple.
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for any product warranties.
Apple is not responsible for addressing any claims related to the App.
Apple is a third-party beneficiary of these Terms.
