By downloading, installing, or using PainMap ("the App," "the Service"), developed by Adam Kaminski ("Developer," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all users of PainMap (Bundle ID: com.kaminskiperformance.painmap) and constitute a legally binding agreement between you and Adam Kaminski.
PainMap is a wellness companion application designed to help users log and monitor pain levels, body areas of discomfort, mood, sitting hours, and exercise activity. The App provides personal tracking tools and progress summaries for self-awareness purposes.
PainMap is not a medical device, diagnostic tool, or substitute for professional medical care.
You must be at least 13 years of age to use PainMap. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet these age requirements.
PainMap may include exercise guidance, movement suggestions, and wellness recommendations. You acknowledge and agree that:
PainMap does not diagnose, treat, cure, or prevent any medical condition or disease. Nothing in the App constitutes medical advice. The App is a personal wellness journaling and self-monitoring tool. Any health-related information displayed by the App is informational only and should not replace consultation with a licensed healthcare professional.
PainMap offers optional subscription plans that unlock premium features ("PainMap Pro"). The following terms apply to all subscriptions:
All content, features, design, code, trademarks, logos, and materials within PainMap are the exclusive property of Adam Kaminski or are used under license. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Adam Kaminski from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of PainMap, your violation of these Terms, or your violation of any applicable law or third-party rights.
Your use of PainMap is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.
PainMap integrates with third-party services including RevenueCat for subscription management and Apple for payment processing. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
We reserve the right to terminate or suspend your access to PainMap at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.
These Terms are governed by and construed in accordance with the laws of Poland and, where applicable, the laws of the European Union, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of PainMap shall first be attempted to be resolved through informal negotiation by contacting us at 23adamkaminski@gmail.com. If informal resolution is unsuccessful, disputes shall be submitted to the competent courts of Poland.
If you are a consumer resident of the European Union, you may also submit complaints to the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the effective date at the top of this page. Your continued use of PainMap after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
