Terms of Use

PainMap — Effective Date: March 23, 2026

1. Acceptance of Terms

By downloading, installing, or using PainMap ("the App," "the Service"), developed by Adam Kaminski ("Developer," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of PainMap (Bundle ID: com.kaminskiperformance.painmap) and constitute a legally binding agreement between you and Adam Kaminski.

2. Description of the App

PainMap is a wellness companion application designed to help users log and monitor pain levels, body areas of discomfort, mood, sitting hours, and exercise activity. The App provides personal tracking tools and progress summaries for self-awareness purposes.

PainMap is not a medical device, diagnostic tool, or substitute for professional medical care.

3. Eligibility

You must be at least 13 years of age to use PainMap. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet these age requirements.

4. Use at Your Own Risk — Exercise and Health Features

PainMap may include exercise guidance, movement suggestions, and wellness recommendations. You acknowledge and agree that:

• All exercise and physical activity features are used entirely at your own risk
• You are responsible for assessing your own physical condition and fitness level before engaging in any exercise activity
• You should consult a licensed physician or physical therapist before beginning any exercise program, especially if you have existing injuries, chronic conditions, or pain
• The Developer is not responsible for any injury, harm, or adverse health outcome resulting from use of the App's exercise or wellness features
• Pain data logged in the App should be shared with your healthcare provider and not used as a sole basis for health decisions

5. Not a Medical Device

PainMap does not diagnose, treat, cure, or prevent any medical condition or disease. Nothing in the App constitutes medical advice. The App is a personal wellness journaling and self-monitoring tool. Any health-related information displayed by the App is informational only and should not replace consultation with a licensed healthcare professional.

6. Subscriptions and In-App Purchases

PainMap offers optional subscription plans that unlock premium features ("PainMap Pro"). The following terms apply to all subscriptions:

• Billing: Subscriptions are billed through the Apple App Store. All transactions are processed by Apple.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled at least 24 hours before the end of the current period.
• Renewal charge: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period.
• Free trials: If a free trial is offered, any unused portion is forfeited when you purchase a subscription before the trial ends.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period; access continues until then.
• Refunds: All refund requests are handled by Apple in accordance with Apple's refund policies. We do not process refunds directly.
• Price changes: We reserve the right to modify subscription pricing. Price changes will be communicated in advance and will take effect at the next renewal after notice.

7. Intellectual Property

All content, features, design, code, trademarks, logos, and materials within PainMap are the exclusive property of Adam Kaminski or are used under license. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App to develop competing products or services
• Remove or alter any proprietary notices or labels

8. User Conduct

You agree to use PainMap only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable local, national, or international law or regulation
• Attempt to gain unauthorized access to any part of the App or its related systems
• Use the App to transmit any harmful, offensive, or disruptive content
• Interfere with the proper functioning of the App

9. Disclaimer of Warranties

PainMap is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or free of viruses or other harmful components
• Warranties regarding the accuracy, reliability, or completeness of any content or information provided by the App

10. Limitation of Liability

To the maximum extent permitted by applicable law, Adam Kaminski shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App
• Any physical injury, including musculoskeletal injury, arising from exercise or wellness activities performed based on App content
• Loss of data resulting from device loss, damage, or malfunction
• Any inaccuracies in wellness tracking or progress data displayed by the App
• Any health decisions made based on App data without consultation with a healthcare professional

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Adam Kaminski from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of PainMap, your violation of these Terms, or your violation of any applicable law or third-party rights.

12. Privacy

Your use of PainMap is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy.

13. Third-Party Services

PainMap integrates with third-party services including RevenueCat for subscription management and Apple for payment processing. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

14. Termination

We reserve the right to terminate or suspend your access to PainMap at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or applicable law. Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Poland and, where applicable, the laws of the European Union, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of PainMap shall first be attempted to be resolved through informal negotiation by contacting us at 23adamkaminski@gmail.com. If informal resolution is unsuccessful, disputes shall be submitted to the competent courts of Poland.

If you are a consumer resident of the European Union, you may also submit complaints to the Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. If we make material changes, we will update the effective date at the top of this page. Your continued use of PainMap after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
